1. Acceptance of Terms

By downloading, installing, accessing, or using NutriApp (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not install or use the App. These Terms constitute a legally binding agreement between you and umisoft.ba ("we", "our", or "us").

2. Medical Disclaimer

NUTRIAPP IS AN AI-POWERED TOOL FOR NUTRITIONAL ESTIMATION. IT IS NOT A MEDICAL DEVICE. THE NUTRITION INFORMATION PROVIDED (CALORIES, MACRONUTRIENTS, MICRONUTRIENTS, AND RECOMMENDATIONS) ARE AI-GENERATED ESTIMATIONS ONLY AND MAY NOT BE 100% ACCURATE.

• This App does not provide medical advice, diagnosis, or treatment.
• Always consult a qualified healthcare professional, registered dietitian, or physician before making significant changes to your diet, exercise routine, or lifestyle.
• Do not disregard professional medical advice or delay seeking it because of information provided by this App.
• If you have a medical condition, food allergy, or dietary restriction, verify all nutrition information independently.

3. AI-Generated Content

NutriApp uses artificial intelligence to analyze food images, generate nutrition data, create meal plans, and provide health coaching responses. You acknowledge that:

• AI-generated nutrition estimates are approximations and may contain errors or inaccuracies.
• We are not liable for any decisions, dietary choices, or health outcomes based on AI-generated content.
• You should verify critical nutrition information through alternative means when accuracy is essential (e.g., packaged food labels, professional nutritionist consultation).

4. Subscriptions and Payments

NutriApp offers optional premium features through auto-renewing subscriptions:

• Payment: All payments are processed by Google Play Billing. We do not store or process your payment information directly.
• Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Cancellation: You can manage or cancel your subscription at any time through your Google Play account settings.
• Price Changes: We reserve the right to modify subscription pricing. We will notify you of any price changes before they take effect.
• Refunds: Refund requests are handled according to Google Play's refund policies. We may grant or deny refunds at our reasonable discretion.

5. User Accounts

To access certain features, you may need to create an account using Google Sign-In or email authentication. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Providing accurate and complete account information.
• Notifying us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

6. User Conduct

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws.
• Upload any content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• Reverse engineer, decompile, disassemble, or attempt to extract the source code of the App.
• Use the App to transmit viruses, malware, or any other malicious code.
• Interfere with or disrupt the App's servers, networks, or functionality.
• Exploit the App for any unauthorized commercial purpose.

7. Intellectual Property

The App, including its code, design, graphics, name, logo, and all content (excluding user-generated content), is the exclusive property of umisoft.ba and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

8. Referral Program

NutriApp may offer a referral program where users can earn virtual coins by referring new users. We reserve the right to modify, suspend, or terminate the referral program at any time. Virtual coins earned through referrals have no cash value and cannot be exchanged for real currency. Fraudulent or abusive referral activity may result in forfeiture of coins and account suspension.

9. Third-Party Services

The App integrates third-party services including Google Firebase, Google AdMob, and Google Play Billing. Your use of these services is subject to their respective terms and policies. We are not responsible for the content, functionality, or practices of third-party services.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• umisoft.ba shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from your use of or inability to use the App.
• Our total liability for any claims relating to the App shall not exceed the amount you paid us (if any) for the use of the App in the 12 months preceding the claim.
• The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.

11. Indemnification

You agree to indemnify, defend, and hold harmless umisoft.ba and its officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

12. Modifications to the Service and Terms

We reserve the right to modify, suspend, or discontinue the App or any part thereof at any time, with or without notice. We also reserve the right to update these Terms at any time. We will notify you of material changes by posting the updated Terms within the App and on this page. Your continued use of the App after changes become effective constitutes acceptance of the new Terms.

13. Termination

We may terminate or suspend your access to the App at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App will immediately cease. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) shall survive.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Bosnia and Herzegovina, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Tuzla, Bosnia and Herzegovina.
